It amends W.S. 15-7-101(a)(iii)(B) to include new provisions that require municipalities to prescribe and regulate rates for the diversion or management of surface water runoff, specifically stating that these actions must be in compliance with the Surface Water Drainage Utility Act and contingent upon holding an election as required by W.S. 16-10-105.
Additionally, the bill stipulates that any municipality that previously adopted ordinances for collecting fees related to surface water management without holding the necessary election must conduct such an election by July 1, 2027. If the electorate does not approve the financing proposition, the municipality is required to stop collecting any related fees within sixty days of the election results. The act is set to take effect on July 1, 2026.
