The proposed bill establishes new legal provisions regarding the protection of commercial nuclear facilities in Wyoming. It introduces an affirmative defense for armed nuclear security guards who use defensive force to protect these facilities, allowing them to act against individuals committing crimes such as burglary, criminal entry, or trespass. The bill defines key terms, including "armed nuclear security guard," "commercial nuclear facility," and "protected area," and grants these guards the authority to detain individuals suspected of committing offenses related to the facility. Additionally, it specifies that guards using defensive force will not be liable under civil or criminal law for actions taken in accordance with the new provisions.
Furthermore, the bill creates a new offense of criminal trespass specifically for commercial nuclear facilities, making it a felony punishable by up to five years in prison and/or a fine of up to $1,000. The definitions established in the section regarding the use of force will also apply to the trespass offense. The act is set to take effect on July 1, 2026.
