This bill amends existing law to authorize the trustees of county memorial hospitals and boards of county commissioners to initiate bankruptcy proceedings on behalf of these hospitals. Specifically, it allows trustees to vote to file for bankruptcy under Chapter 9 of the United States Bankruptcy Code or to dissolve and terminate the hospital. The bill outlines that any such action requires the approval of the board of county commissioners, ensuring that the bankruptcy petition and initial plan for debt adjustment or the dissolution plan are sanctioned before proceeding.

Additionally, if the board of county commissioners approves the bankruptcy petition or the dissolution plan, the trustees are empowered to take necessary actions to confirm the bankruptcy plan or to effectuate the dissolution of the hospital. The effective date for this act is set for July 1, 2026.
