The proposed bill establishes new legal provisions regarding the use of defensive force in the protection of commercial nuclear generating facilities in Wyoming. It introduces an affirmative defense for armed nuclear security guards who use defensive force, including deadly force, if they reasonably believe it is necessary to prevent or terminate certain crimes, such as burglary or acts of radiological sabotage, within a protected area of the facility. The bill also defines key terms related to the security and operation of nuclear facilities, including "armed nuclear security guard," "commercial nuclear generating station," and "criminal trespass at a commercial nuclear generating station."
Additionally, the bill creates a new offense of criminal trespass specifically for commercial nuclear generating stations, making it a felony punishable by up to five years in prison and/or a fine. It grants armed nuclear security guards the authority to detain individuals suspected of committing offenses related to the facility, providing them with legal protection against civil or criminal liability for such detentions if they act on reasonable belief. The act is set to take effect on July 1, 2026.
