The bill amends existing laws regarding the process by which counties can decrease maximum speed limits on highways. It introduces a new provision that allows the transportation commission to override a board of county commissioners' resolution to decrease speed limits, provided that the commission acts within sixty days of receiving the resolution. If the commission does not take action within this timeframe, it waives its ability to override the resolution. Additionally, the bill specifies that counties may decrease speed limits on certain streets and highways, excluding interstate highways, but must submit their adopted resolutions to the commission within sixty days.
The bill also makes conforming amendments to ensure that local authorities can establish maximum speed limits in compliance with the rules set by the department of transportation. It clarifies that any alterations to maximum speed limits on state highways by local authorities will not take effect until approved by the superintendent, except in cases where the county has adopted a resolution to decrease the speed limit, which can be overridden by the commission. The provisions of this act will apply to proposed changes made by county commissioners starting July 1, 2025, with the act itself becoming effective on that date.
