The bill amends Wyoming's public health and safety laws regarding the liability of pesticide manufacturers and sellers. It introduces a new subsection (e) to W.S. 35-7-360, which establishes that a manufacturer or seller's duty to warn consumers about pesticide risks is presumed to be met if the pesticide carries a label approved by the United States Environmental Protection Agency (EPA) and is registered with the state department. This presumption can only be challenged by demonstrating that the scientific evidence does not support the warning's basis and that the manufacturer or seller was aware or should have been aware of this lack of support at the time of sale.
Additionally, the bill clarifies that the existing liability provisions remain in effect, meaning that manufacturers and sellers can still be held liable for damages caused by pesticide use, regardless of compliance with the act's regulations. The effective date for this legislation is set for July 1, 2025.
