This bill amends existing property law in Wyoming to require sellers of vacant land to provide prospective buyers with a property disclosure statement that includes information about the ownership of pore space. Specifically, it adds a new requirement for sellers to disclose whether the ownership interest in the pore space has been severed from the surface ownership. Additionally, the bill modifies the existing law regarding the conveyance of surface ownership, mandating that all conveyances include a notice indicating whether the pore space ownership is included in the transaction.
The bill also clarifies that unless explicitly excluded, the conveyance of surface ownership includes the pore space beneath it, and it establishes that the ownership of pore space can be transferred similarly to mineral interests. The provisions of this act will apply to all real property conveyances occurring on or after July 1, 2025, with the act itself taking effect on that same date.
