The bill amends existing laws regarding criminal trespass and game-and-fish trespass in Wyoming by introducing exceptions for incidental contact when crossing adjacent parcels of land. Specifically, it states that a person does not commit criminal trespass if they incidentally pass through the airspace or touch the land of another while traveling between two parcels they are authorized to access, provided these parcels share a common corner or are immediately connected. This new language is added to W.S. 6-3-303 and W.S. 23-3-305(b).
Additionally, the bill clarifies that the definition of "travel through or return across" private property does not apply if the person is merely passing through the airspace or touching the land while moving between authorized parcels. This change aims to provide clearer guidelines for individuals who may inadvertently cross onto private property while accessing adjacent lands. The act is set to take effect on July 1, 2025.
