The bill amends Wyoming Statute 9-1-305 to allow the Secretary of State to charge a fee for expediting the filing of certain documents, specifically those filed under titles 17, 34, or 40, chapters 1 and 2 of the Wyoming statutes. The maximum fee for this expedited service is set at five thousand dollars ($5,000.00). The Secretary of State is required to establish the fee and the process for requesting expedited filings through rules that consider the costs associated with the filing and the deadlines mandated by law. Importantly, expedited filings will not receive any preferential treatment regarding the timing of the filing compared to non-expedited filings.
Additionally, the bill authorizes the Secretary of State to create one full-time position to implement the provisions of this act, with an appropriation of ninety-three thousand one hundred seventy-nine dollars ($93,179.00) from the general fund for this purpose, effective until June 30, 2026. This appropriation is intended to be included in the Secretary of State's standard budget request for the following fiscal biennium. However, the effectiveness of this authorization and appropriation is contingent upon the absence of additional full-time positions being authorized for the Secretary of State in other pending legislation. The act is set to take effect on July 1, 2025.
