Hathaway scholarship-amendments.

A BILL
for
1 AN ACT relating to the Hathaway scholarship program;
2 clarifying that the definition of "certificate" includes
3 trade certificate programs; requiring students to work or
4 attend graduate school in Wyoming for a specified time in
5 order to receive a Hathaway scholarship; requiring
6 rulemaking; specifying applicability; and providing for
7 effective dates.

9 Be It Enacted by the Legislature of the State of Wyoming:
10
11 Section 1. W.S. 21-16-1301(a)(iv) and
12 21-16-1303(b)(intro) and by creating a new paragraph (iv)
13 are amended to read:

2 (a) As used in this article:
3
4 (iv) "Certificate" means a credential other than
5 a degree as defined in paragraph (vi) of this subsection. A
6 "certificate" is either an associate of applied science
7 degree, or indicates satisfactory completion of training in
8 an academic year program of study offered by a Wyoming
9 community college or satisfactory completion of a program
10 of study offered by a Wyoming community college that
11 results in a license, permit, certificate or other
12 government or industry recognized qualification for working
13 in a trade or occupation in this state, including, but not
14 limited to, drivers of commercial motor vehicles, welders,
15 machine shop operators or other workforce training
16 programs;

21 (b) Under the Hathaway scholarship program, subject
22 to availability of funds as determined by the legislature,
23 the state shall provide a scholarship pursuant to W.S.

1 21-16-1304 and 21-16-1305 to any student who has been
2 accepted by and enrolls in an eligible institution to
3 pursue a degree or certificate, and who meets the following
4 qualifications and requirements:

6 (iv) The student enters into an agreement with
7 the department under which the student agrees to actively
8 engage in work in Wyoming for one (1) year or attend
9 graduate school at the University of Wyoming for one (1)
10 year, for every four (4) academic semesters or portions
11 thereof in which a Hathaway scholarship was received. The
12 department shall establish by rule the commencement of the
13 period for undertaking the requirements of this paragraph,
14 which shall begin not later than one (1) year after the
15 completion of the last semester in which a Hathaway
16 scholarship was received.

18 Section 2. The agreement required under W.S.
19 21-16-1303(b)(iv) as created by section 1 of this act shall
20 apply to any scholarship first awarded under the Hathaway
21 scholarship program on or after July 1, 2025.

1 Section 3. The Wyoming department of education shall
2 adopt rules necessary to implement section 1 of this this
3 act not later than July 1, 2025.

5 Section 4.

7 (a) Except as provided in subsection (b) of this
8 section, this act is effective immediately upon completion
9 of all acts necessary for a bill to become law as provided
10 by Article 4, Section 8 of the Wyoming Constitution.

12 (b) Section 1 of this act is effective July 1, 2025.
