This bill amends the zoning protest process for cities and towns in Wyoming by modifying the criteria under which a protest against changes in zoning regulations can be deemed effective. Specifically, it changes the requirement from needing a protest signed by owners of twenty percent (20%) of the area affected to requiring signatures from owners who can demonstrate a concrete and particularized harm and either own thirty-three percent (33%) or more of the area of the lots included in the proposed change or comprise thirty-three percent (33%) or more of the owners immediately adjacent within a distance of three hundred (300) feet. Additionally, the bill alters the voting requirement for the governing body from an affirmative vote of three-fourths (3/4) to two-thirds (2/3) of all members.
The bill also specifies that the new provisions will apply to protests filed on or after July 1, 2025, and establishes that the act will take effect on the same date. This legislative change aims to streamline the zoning protest process while ensuring that the voices of property owners who may be significantly impacted by zoning changes are adequately represented.
