The bill amends the zoning protest process for cities and towns in Wyoming, specifically addressing the criteria under which a protest against changes in regulations, restrictions, or district boundaries can be deemed effective. It stipulates that a protest must be signed by more than one owner who can demonstrate a concrete and particularized harm and who either owns thirty-three percent (33%) or more of the area of the lots included in the proposed change or comprises thirty-three percent (33%) or more of the owners immediately adjacent within a distance of three hundred (300) feet. The bill also changes the requirement for the governing body’s approval from an affirmative vote of three-fourths (3/4) to two-thirds (2/3) of all members.
Additionally, the bill specifies that the width of any intervening street or alley will not be included when determining the three hundred (300) feet distance for adjacent owners. The new provisions will apply to protests filed on or after July 1, 2025, and the act will take effect on the same date.
