This bill amends the zoning protest process for cities and towns in Wyoming, specifically altering the criteria under which a protest against changes in regulations, restrictions, or district boundaries can render such changes ineffective. The new language specifies that a protest must be signed by more than one owner who can demonstrate a concrete and particularized harm and who either owns thirty-three percent (33%) or more of the area of the lots included in the proposed change or comprises thirty-three percent (33%) or more of the owners immediately adjacent within a distance of three hundred (300) feet. Additionally, the requirement for an affirmative vote to enact the change has been adjusted from three-fourths (3/4) to two-thirds (2/3) of the governing body members.
The bill also clarifies that the width of any intervening street or alley will not be included when determining the three hundred (300) feet distance for adjacent owners. This act will apply to protests filed on or after July 1, 2025, and will take effect on the same date.
