This bill amends the zoning protest process for cities and towns in Wyoming, specifically addressing the criteria under which a protest against changes in zoning regulations can be deemed effective. The new language specifies that a protest must be signed by more than one owner who can demonstrate a concrete and particularized harm and who either owns thirty-three percent (33%) or more of the area of the lots included in the proposed change or comprises thirty-three percent (33%) or more of the owners immediately adjacent within a distance of three hundred (300) feet. The previous requirement of twenty percent (20%) ownership and a distance of one hundred forty (140) feet has been deleted. Additionally, the threshold for the governing body's affirmative vote to enact the change has been adjusted from three-fourths (3/4) to two-thirds (2/3).
The bill also establishes that these changes will apply to protests filed on or after July 1, 2025, and sets the effective date of the act to the same date. This legislative change aims to clarify and potentially streamline the zoning protest process while ensuring that the voices of affected property owners are adequately represented.
