A BILL
for
1 AN ACT relating to motor vehicles; amending expiration and
2 renewal of licenses for persons under twenty-one (21) years
3 of age; amending identification card contents; clarifying
4 the timeline for contested case hearings regarding
5 licenses; amending requirements for replacement licenses;
6 adding a fee for replacement licenses; repealing obsolete
7 provisions; providing rulemaking authority; and providing
8 for effective dates.

10 Be It Enacted by the Legislature of the State of Wyoming:
11
12 Section 1. W.S. 31-7-105(e), 31-7-113(a) by creating
13 a new paragraph (xiii), 31-7-115(b), 31-7-118 and
14 31-8-102(a)(vii) are amended to read:

1 31-7-105. Administrative hearings.

3 (e) The licensee has twenty (20) days from the date
4 the department denies the license or gives the notice of
5 intent to suspend, revoke or cancel the license or
6 disqualify the licensee from driving a commercial motor
7 vehicle within which to request a hearing or the
8 opportunity for a hearing is waived. If the request for a
9 hearing is timely and the request is for a contested case,
10 the department shall forward the request and certified
11 record to the hearing examiner who shall schedule a hearing
12 within forty-five (45) days after receipt of the certified
13 record at a time and place specified by the hearing
14 examiner. The hearing examiner shall provide the licensee
15 notice of the hearing at least ten (10) days in advance of
16 the hearing. If the hearing examiner fails to schedule the
17 hearing within forty-five (45) days of the request receipt
18 of the certified record from the department, other than at
19 the request of the licensee, the licensee, as his sole
20 remedy, shall be given credit against any action upheld at
21 the hearing for the time between the expiration of the
22 forty-five (45) day period and the date the hearing was
23 first scheduled. The hearing examiner may administer oaths,

1 subpoena and compel the attendance of witnesses or the
2 production of relevant books, papers and other evidence
3 reasonably necessary to resolve the matters under
4 consideration in accordance with W.S. 16-3-101 through
5 16-3-115 and may require reexamination of the licensee. The
6 hearing examiner shall issue subpoenas upon his own motion
7 or upon the request of any party to the proceedings in
8 compliance with the Wyoming Rules of Civil Procedure. Upon
9 hearing, the hearing examiner shall either rescind or
10 uphold the action or upon a showing of good cause, may
11 continue or modify a suspension of the license.

13 31-7-113. Fees.
14
15 (a) The following fees are imposed, in addition to
16 the fee in subsection (g) of this section:
17
18 (xiii) Replacement license under W.S. 31-7-118 .

1 (b) Licenses issued to persons under twenty-one (21)
2 years of age shall bear distinctive markings indicating the
3 licensee is under twenty-one (21) years. After January 1,
4 1994, a license and shall expire no later than when the
5 licensee attains twenty-one (21) years of age. The
6 department shall notify the licensee at least ninety (90)
7 days prior to his twenty-first birthday of the expiration
8 date of his license. A licensee may apply for a license
9 within ninety (90) days of attaining the age of twenty-one
10 (21) years, payment of the proper fee and surrender of the
11 original license in accordance with W.S. 31-7-119(a).

13 31-7-118. Replacement license.

15 (a) If a license issued under this act is lost,
16 destroyed or if the licensee desires to withdraw or insert
17 notice of anatomical organ donation or a medical alert
18 designation, the person may obtain the appropriate
19 replacement license upon payment of the proper fee and
20 surrender of the original license, if available.

22 (b) The department may issue a replacement license
23 under this section without the examinations required under

1 W.S. 31-7-114, except for a commercial driver's license
2 with a hazardous materials endorsement, upon request by the
3 licensee either by mail or in person if the following
4 conditions exist:

6 (i) The expiration date of the licensee's
7 original license is more than one (1) year from the date of
8 the licensee's request for a replacement license;
9
10 (ii) The licensee has not legally changed the
11 licensee's name since issuance of the licensee's original
12 license; and
13
14 (iii) The department has a digitized photograph
15 and signature of the licensee on record.

17 (c) A replacement license issued under this section
18 shall expire on the expiration date of the licensee's
19 original license.

1 (a) The identification card or digital identification
2 card shall resemble a Wyoming driver's license or digital
3 driver's license. It shall have:
4
5 (vii) The following: "State of
6 Wyoming"-"Identification Card No. ...."-"This card is
7 provided solely for the purpose of identification of the
8 person described on the card FOR IDENTIFICATION PURPOSES
9 ONLY";

11 Section 2. W.S. 31-7-113(a)(iv) and 31-7-119(e) are
12 repealed.

14 Section 3. The department of transportation shall
15 promulgate rules as necessary to implement this act.

1 Section 4.

3 (a) Except as provided in subsection (b) of this
4 section, this act is effective July 1, 2025.
5
6 (b) Sections 3 and 4 of this act are effective
7 immediately upon completion of all acts necessary for a
8 bill to become law as provided by Article 4, Section 8 of
9 the Wyoming Constitution.
