The bill establishes an affirmative defense for the use of force by state security officers and members of the armed forces when defending military equipment. It allows these individuals to use reasonable force, including deadly force, in accordance with military regulations while on official duty. The bill also introduces a new definition for "state security officer," specifying that these individuals are employed by the military department and are responsible for securing military assets.
Additionally, the bill extends immunity from civil or criminal liability to state security officers and members of the Wyoming National Guard in active state service for acts performed in the course of their duties, provided those acts are not palpably illegal, excessively violent, or malicious. It ensures that if any civil action is brought against them, they are entitled to legal counsel at state expense. The provisions of this act will take effect on July 1, 2025.
