The proposed bill establishes a comprehensive framework for public utilities in Wyoming to create and implement wildfire mitigation plans, which must be submitted to the Public Service Commission (PSC) for approval. These plans are required to include essential components such as service territory descriptions, inspection procedures, vegetation management strategies, and protocols for de-energizing power lines to mitigate wildfire risks. While utilities can seek cost recovery for implementing these plans through rate cases, the approval of a plan does not guarantee automatic cost recovery.
Additionally, the bill introduces liability limitations for electric utilities concerning wildfires, allowing plaintiffs to recover economic losses only if they can prove that the utility did not comply with an approved wildfire mitigation plan or acted with malice. It also establishes a four-year statute of limitations for civil actions related to wildfire damages against utilities. The legislation aims to enhance public safety and accountability while providing a structured approach to managing wildfire risks. The PSC is tasked with promulgating necessary rules for the act's implementation, which will take effect immediately after the legislative process, except for Section 1, which will become effective on July 1, 2025.
