The bill establishes new responsibilities regarding the fencing of state lands in Wyoming. Specifically, it mandates that the office of state lands and investments or the lessees are responsible for fencing state lands when livestock from privately owned adjoining lands stray onto them. This shifts the responsibility away from the adjoining private landowners. Additionally, the bill prohibits the office of state lands and investments from pursuing trespass actions against livestock owners solely based on the grounds of livestock straying onto unfenced state lands that do not meet the requirements outlined in W.S. 11-28-102. However, it clarifies that this provision does not limit any liability under W.S. 11-28-108 for state lands that are enclosed by lawful fencing.

To implement this act, the office of state lands and investments is required to promulgate necessary rules. The act is set to take effect on July 1, 2025, with the exception of Sections 2 and 3, which will become effective immediately upon the completion of all necessary legislative processes.
