A BILL
for
1 AN ACT relating to state land leases; authorizing state
2 land lease applicants a grace period to correct
3 deficiencies in their applications; and providing for an
4 effective date.

6 Be It Enacted by the Legislature of the State of Wyoming:

8 Section 1. W.S. 36-5-103 is amended to read:
9
10 36-5-103. Application for lease; cancellation of
11 application; deficiencies in application; grace period.

1 (a) Any person, firm, association or corporation
2 desiring to lease state lands for agricultural and grazing
3 purposes shall file with the director an application on the
4 form approved by the board, which must be accompanied by
5 the regular filing fee and payment acceptable to the
6 director for the full amount of the first year's rental
7 offered. If there are improvements owned by another located
8 upon said lands, the applicant must also transmit in the
9 manner above provided, the estimated amount of the value of
10 the improvements as listed in his application, and in the
11 event the successful applicant fails, refuses or neglects
12 to complete the lease awarded, or otherwise fails, refuses,
13 or neglects to comply with the provisions of this act, or
14 the rules and regulations of the board, after having been
15 given thirty (30) days notice by registered mail, the
16 application shall be cancelled and the sum remitted as
17 rentals and twenty-five percent (25%) of the sum remitted
18 for improvements shall be retained by the board as
19 liquidated damages; and the sum paid as rental shall be
20 paid by the director to the state treasurer and credited by
21 him to the proper permanent land income fund account, and
22 the sum paid for improvements shall be credited to the
23 general fund.

2 (b) For good cause shown and at the written request
3 of the applicant, the director may grant an applicant
4 applying to lease state lands thirty (30) additional days
5 after the expiration of the thirty (30) day notice period
6 specified in subsection (a) of this section to correct any
7 deficiencies in their application, send the regular filing
8 fee or the full amount of the first year’s rental to the
9 board, comply with the provisions of this act, comply with
10 the rules and regulations of the board or complete the
11 lease awarded.

18 giving applicants 60 days rather than 30 to correct their
19 applications or otherwise comply with the Board’s rules and
20 regulations.
