A BILL
for
1 AN ACT relating to school building and facility projects;
2 providing for supplemental appropriations for the period
3 commencing July 1, 2025 and ending June 30, 2026;
4 specifying conditions for expenditures; reappropriating
5 funds; and providing for an effective date.

7 Be It Enacted by the Legislature of the State of Wyoming:

23 subsection (j) of this section, as adopted by the
24 school facilities commission and as contained
25 within the 2025-2026 biennial budget, inclusive
26 of the supplemental budget request, submitted by
27 the commission under W.S. 21-15-119, and further

1 refined by the budget submitted by the governor's
2 office, shall be used by the state construction
3 department to the extent practicable to guide
4 expenditure of appropriated funds, subject to
5 restrictions contained in W.S. 21-15-119(c). The
6 estimated schedule shall be based upon
7 information, processes, events and expenditures
8 and shall not be binding upon the state
9 construction department or the school facilities
10 commission.

12 (j) The following amounts are appropriated
13 from the school foundation program account to the
14 school facilities commission for the following
15 purposes:

17 (iv) For construction of the following
18 school building and facility projects, two
19 hundred forty-one million three hundred seventy-
20 four thousand thirteen dollars ($241,374,013.00)

9 high school and a transportation facility in
10 Campbell county school district #1 and an
11 elementary school in Albany county school
12 district #1, two million six hundred thirty-four
13 thousand six hundred ninety-eight dollars
14 ($2,634,698.00) nine million eight hundred
15 ninety-one thousand two hundred forty-six dollars
16 ($9,891,246.00). Any disposition or demolition of
17 buildings or facilities shall be subject to
18 commission approval and included in the
19 district's facility plan to ensure the
20 disposition or demolition protects the financial
21 interest of the state and is in the public
22 interest as required under W.S. 21-15-123(f)(vi);

2 (xii) For unanticipated costs
3 associated with the projects funded under
4 paragraphs (j)(iii) through (xi) of this
5 subsection, ten million four hundred thirty-six
6 thousand eight hundred eighty-six dollars
7 ($10,436,886.00) twenty-three million one hundred
8 fourteen thousand four hundred forty-two dollars
9 ($23,114,442.00).

11 (k) Notwithstanding any other provision of
12 law, of the unexpended, obligated monies
13 appropriated from the school capital construction
14 account to the school facilities commission under
15 2023 Wyoming Session Laws, Chapter 94, Section
16 313(j)(xiii), up to thirteen million four hundred
17 thousand dollars ($13,400,000.00), or as much
18 thereof as is available, shall not revert upon
19 completion of the projects pursuant to 2023
20 Wyoming Session Laws, Chapter 94, Section 313(d),
21 and are hereby reappropriated to the school
22 facilities commission to supplement previous

1 appropriations for inflationary costs associated
2 with projects approved by the commission and
3 funded by the legislature. The original scope and
4 design of the projects for which these funds are
5 expended shall not be modified as a result of the
6 expenditure of the funds reappropriated under
7 this subsection. This reappropriation shall not
8 be transferred or expended for any other purpose.
9 The commission shall report the expenditure of
10 funds reappropriated under this subsection as
11 required under subsection (h) of this section.

13 Section 3. This act is effective immediately upon
14 completion of all acts necessary for a bill to become a law
15 as provided by Article 4, Section 8 of the Wyoming
16 Constitution.
