A BILL
for
1 AN ACT relating to K-12 public school finance; increasing
2 the allowable square footage utilized to calculate routine
3 and major maintenance for school districts; increasing the
4 percentage utilized to calculate major maintenance payments
5 to school districts; providing appropriations; and
6 providing for an effective date.

8 Be It Enacted by the Legislature of the State of Wyoming:

10 Section 1. W.S. 21-13-309(m)(v)(G)(II) and
11 21-15-109(c)(iii)(C), (vi) and (vii) are amended to read:

1 21-13-309. Determination of amount to be included in
2 foundation program for each district.

4 (m) In determining the amount to be included in the
5 foundation program for each district, the state
6 superintendent shall:
7
8 (v) Based upon ADM computations and identified
9 school configurations within each district pursuant to
10 paragraph (iv) of this subsection, compute the foundation
11 program amount for each district as prescribed by the
12 education resource block grant model adopted by the Wyoming
13 legislature as defined under W.S. 21-13-101(a)(xiv), as
14 contained within the spreadsheets and accompanying reports
15 referenced under W.S. 21-13-101(a)(xvii). The following
16 criteria shall be used by the state superintendent in the
17 administration of the education resource block grant model:

19 (G) Amounts within the block grant model
20 for maintenance and operations shall be based upon actual
21 gross square footage of school buildings and facilities
22 subject to the following:

2 (II) Actual gross square footage of
3 education space shall be the gross square footage
4 prescribed by statewide building adequacy standards
5 promulgated pursuant to W.S. 21-15-115. For school year
6 2025-2026 and each school year thereafter, education space
7 capacity in excess of one hundred fifteen percent (115%)
8 one hundred thirty-five percent (135%) of the standard
9 space level shall not be included in actual gross square
10 footage computations under this subdivision;
11
12 21-15-109. Major building and facility repair and
13 replacement payments; computation; square footage
14 allowance; use of payment funds; accounting and reporting
15 requirements.

17 (c) To compute the major building and facility repair
18 and replacement payment for each district, the department
19 shall:
20
21 (iii) Except as otherwise provided by this
22 paragraph, adjust the total amount of gross square footage

1 determined for educational buildings under subparagraph
2 (c)(ii)(C) of this section by excluding from computations
3 under this section the square footage for those educational
4 buildings closed and not operational as provided for under
5 paragraph (c)(iv) of this section and any amount including
6 the gross square footage of portable buildings, which
7 exceeds capacity levels specified by this paragraph which
8 are above the statewide minimum gross square footage
9 criteria as prescribed by the statewide building and
10 facility adequacy standards promulgated under W.S.
11 21-15-115(a). For the purpose of adjusting the gross square
12 footage of educational buildings under this paragraph, the
13 gross square footage of buildings used for the provision of
14 certified child care, developmental preschool and
15 cooperative education programs pursuant to subparagraph
16 (c)(i)(A) of this section shall not be excluded. For
17 purposes of this section, per student gross square footage
18 criteria prescribed by the statewide building adequacy
19 standards shall be based upon an average daily membership
20 (ADM) computed as defined under W.S. 21-13-101(a)(i) for
21 the prior school year. For purposes of computations under
22 this section, the allowable capacity in educational

1 building gross square footage for each district including
2 portable buildings but excluding buildings used for the
3 provision of certified child care, developmental preschool
4 and cooperative education programs pursuant to subparagraph
5 (c)(i)(A) of this section, shall be as follows:

7 (C) For school year 2009-2010 2025-2026 and
8 each school year thereafter, up to one hundred fifteen
9 percent (115%) one hundred thirty-five percent (135%) of
10 the prescribed per student gross square footage criteria.
11
12 (vi) Multiply the amount computed under
13 paragraph (c)(v) of this section for the adjusted square
14 footage of the district's educational buildings times two
15 and one-half percent (2.5%) for school year 2001-2002,
16 three percent (3%) for school year 2002-2003, and by two
17 percent (2%) for school year 2003-2004 2025-2026 and each
18 school year thereafter;

20 (vii) Multiply the sum of the amounts obtained
21 under paragraph (c)(v) of this section for the building
22 categories identified under subparagraphs (c)(ii)(A) and

1 (D) of this section times two and one-half percent (2.5%)
2 for school year 2001-2002, three percent (3%) for school
3 year 2002-2003, and by two percent (2%) for school year
4 2003-2004 2025-2026 and each school year thereafter,
5 adjusted as follows:

9 (a) There is appropriated thirty-eight million one
10 hundred thousand dollars ($38,100,000.00) from the public
11 school foundation program account to the state construction
12 department for major maintenance payments to school
13 districts made necessary by the amendments enacted in
14 section 1 of this act. This appropriation shall be for the
15 period beginning July 1, 2025 and ending June 30, 2026.
16 This appropriation shall not be transferred or expended for
17 any other purpose and any unexpended, unobligated funds
18 remaining from this appropriation shall revert as provided
19 by law on June 30, 2026. It is the intent of the
20 legislature that this appropriation be included in the
21 standard budget for the state construction department for
22 the immediately succeeding fiscal biennium.

2 (b) There is appropriated five million five hundred
3 thousand dollars ($5,500,000.00) from the public school
4 foundation program account to the department of
5 education-school finance for routine maintenance payments
6 to school districts made necessary by the amendments
7 enacted in section 1 of this act. This appropriation shall
8 be for the period beginning July 1, 2025 and ending June
9 30, 2026. This appropriation shall not be transferred or
10 expended for any other purpose and any unexpended,
11 unobligated funds remaining from this appropriation shall
12 revert as provided by law on June 30, 2026. It is the
13 intent of the legislature that this appropriation be
14 included in the standard budget for the department of
15 education-school finance for the immediately succeeding
16 fiscal biennium.

18 Section 3. This act is effective July 1, 2025.
