A BILL
for
1 AN ACT relating to K-12 school finance; eliminating
2 operating expenditures as a factor in the computation of
3 maintenance workers in the routine maintenance and
4 operations component of the education resource block grant
5 model; providing an appropriation; and providing for an
6 effective date.

8 Be It Enacted by the Legislature of the State of Wyoming:

10 Section 1.

12 (a) For school year 2025-2026 and each school year
13 thereafter, the education resource block grant model, as

1 defined in W.S. 21-13-101(a)(xiv), shall not include a
2 factor for a school district's operating expenditures when
3 computing the maintenance worker base full-time equivalent
4 position resources through the routine maintenance and
5 operations component as contained in paragraph (b)(xxxiii)
6 of "Attachment A" as referenced in W.S. 21-13-101(a)(xvii).
7 Except as specifically provided under subsection (b) of
8 this section, for school year 2025-2026 and each school
9 year thereafter, the maintenance worker resources provided
10 through the routine maintenance and operations component
11 within the education resource block grant model shall be
12 computed in the same manner as school year 2024-2025.

14 (b) For school year 2025-2026 and each school year
15 thereafter, the education resource block grant model's
16 maintenance worker base full-time equivalent position
17 resources contained within the routine maintenance and
18 operations component shall be calculated using the average
19 of the following three (3) factors:

21 (i) One and one-tenth (1.1) maintenance workers
22 per school building;

2 (ii) One (1) maintenance worker multiplied by
3 the total of the allowable gross square footage of
4 education space for the school building in accordance with
5 W.S. 21-13-309(m)(v)(G)(II) divided by sixty thousand
6 (60,000), then multiplied by a factor of one and two-tenths
7 (1.2);

9 (iii) One (1) maintenance worker multiplied by
10 the total average daily membership for the school building
11 divided by one thousand (1,000), then multiplied by a
12 factor of one and three-tenths (1.3). "Average daily
13 membership" means as defined by W.S. 21-13-101(a)(i).

15 Section 2. There is appropriated two million dollars
16 ($2,000,000.00) from the public school foundation program
17 account to the department of education-school finance for
18 routine maintenance payments to school districts made
19 necessary by the amendments enacted in section 1 of this
20 act. This appropriation shall be for the period beginning
21 July 1, 2025 and ending June 30, 2026. This appropriation
22 shall not be transferred or expended for any other purpose

1 and any unexpended, unobligated funds remaining from this
2 appropriation shall revert as provided by law on June 30,
3 2026. It is the intent of the legislature that this
4 appropriation be included in the standard budget for the
5 department of education-school finance for the immediately
6 succeeding fiscal biennium.
