A BILL
for
1 AN ACT relating to pari-mutuel wagering; requiring approval
2 by a city or town for the issuance of pari-mutuel event
3 permits and simulcasting as specified; specifying
4 applicability; and providing for an effective date.

6 Be It Enacted by the Legislature of the State of Wyoming:
7
8 Section 1. W.S. 11-25-102(a)(vii)(B) and 11-25-201(a)
9 are amended to read:

11 11-25-102. Definitions.

13 (a) As used in this act:

2 (vii) "Simulcasting" means the sale of
3 pari-mutuel pools electronically transmitted live or
4 historic on interstate or intrastate pari-mutuel events as
5 prescribed by the commission. The commission shall
6 authorize simulcasting subject to the following conditions:

8 (B) Simulcasting may be conducted off the
9 permitted premises only if approved by:
10
11 (I) The governing body of the city or
12 town, if the simulcasting will be conducted within the
13 corporate limits of any city or town; or
14
15 (II) The board of county commissioners
16 of the county, in which such if the simulcasting will be
17 conducted grant its approval; outside the corporate limits
18 of any city or town.

20 11-25-201. Pari-mutuel permits; fees and reports;
21 disposition of funds; enforcement of provisions.

1 (a) The commission may issue pari-mutuel permits
2 subject to the following:
3
4 (i) Permits shall be issued for a specified
5 period not to exceed three (3) years from the date of
6 issuance;
7
8 (ii) Permits may be issued to:
9
10 (A) Any Wyoming county, city, incorporated
11 town, or county fair board; or
12
13 (B) Any corporation or association which
14 that has been approved by the governing body of the city or
15 town, if the pari-mutuel event will be conducted within the
16 corporate limits of any city or town, or the board of
17 county commissioners, if the pari-mutuel event will be
18 conducted outside the corporate limits of any city or town,
19 and that provides a bond acceptable to the commission.

21 (iii) No permit shall be granted to any city,
22 town, county, county fair board or any corporation or
23 association except upon the express condition that it shall

1 not, by any lease, contract, understanding or arrangement
2 of whatever kind or nature, grant, assign or turn over to
3 any person, corporation or association the operation or
4 management of the pari-mutuel event permitted under this
5 act or of the pari-mutuel system of wagering or in any
6 manner permit any person, corporation or association to
7 retain any of the money received for admission to the race
8 meeting or from the operations of the pari-mutuel system.
9 The commission shall revoke the permit of any permittee for
10 any violation of the foregoing condition specified in this
11 paragraph and such acts are a violation of this act;.

13 (iv) The permit is shall be effective only for
14 the times and at the places for which issued.;
15
16 (v) In addition to all other fees and charges,
17 there shall be charged before issuance of a permit a daily
18 fee established by the commission to defray expenses of
19 enforcing this act.
20
21 Section 2. This act shall apply to pari-mutuel permits
22 and simulcasting permits issued on and after the effective
23 date of this act.
