Possession of alcohol-amendments.

A BILL
for
1 AN ACT relating to alcoholic beverages; amending the
2 penalty for a person under the age of 21 possessing,
3 consuming or having a measurable amount of alcohol in his
4 body; providing for the expungement of a criminal record
5 for a person under the age of 21 possessing, consuming or
6 having a measurable amount of alcohol in his body; making
7 conforming amendments; specifying applicability; and
8 providing for an effective date.

10 Be It Enacted by the Legislature of the State of Wyoming:
11
12 Section 1. W.S. 12-6-101(g) and by creating new
13 subsections (k) and (m) is amended to read:

1 12-6-101. Sale or possession prohibited; when
2 possession unlawful; public drunkenness; falsification of
3 identification; penalty; prima facie identification as
4 defense.

6 (g) Except as otherwise provided in subsection (k) of
7 this section any person who violates this section, or aids,
8 abets or incites any violation hereof, is guilty of a
9 misdemeanor.

11 (k) Any person who violates paragraphs (c)(iii), (iv)
12 or (v) of this section is guilty of a misdemeanor
13 punishable by a fine of not more than two hundred fifty
14 dollars ($250.00).

16 (m) No conviction for a violation of paragraphs
17 (c)(iii), (iv) or (v) of this section, whether by guilty
18 plea, adjudication of guilt or forfeiture of bond shall be
19 reported by the court to any law enforcement agency. Upon
20 payment of the fine imposed by subsection (k) of this
21 section, a criminal conviction for a violation of
22 paragraphs (c)(iii), (iv) or (v) of this section shall be
23 expunged by operation of law from all records of the court

1 six (6) months after the entry of conviction. For any
2 person whose record of conviction was expunged under this
3 subsection, the conviction is deemed not to have occurred
4 and the individual may reply accordingly upon any inquiry
5 in the matter. No expungement under this subsection shall
6 be considered for purposes of any other law providing for
7 expungement.

9 Section 2. This act shall apply to convictions under
10 W.S. 12-6-101(c)(iii), (iv) or (v) on and after July 1,
11 2024.

13 Section 3. This act is effective July 1, 2024.
