Election ballots.

A BILL
for
1 AN ACT relating to elections; providing for the counting of
2 absentee ballots received after the date of the election as
3 specified; modifying the time county canvassing boards
4 shall meet; and providing for an effective date.

6 Be It Enacted by the Legislature of the State of Wyoming:
7
8 Section 1. W.S. 22-9-118, 22-9-119 and
9 22-16-103(c)(i) are amended to read:
10
11 22-9-118. Delivery of absentee ballots and duplicate
12 list to precincts.

14 The clerk shall oversee the delivery of the sealed envelope
15 containing absentee ballots and the duplicate list of

1 absent electors to each precinct polling place before the
2 polls are opened. Absentee ballots returned to the county
3 clerk not later than 7:00 p.m. on election day shall be
4 counted in accordance with W.S. 22-9-119.

6 22-9-119. Late absentee ballots.

8 (a) An absentee ballot postmarked on or before the
9 election day and received by the clerk after the polls
10 close but prior to the convening of the meeting of the
11 county canvassing board shall not be voted. The board of
12 county commissioners shall adopt procedures for the
13 handling, delivery and examination of absentee ballots
14 received in accordance with this subsection.

16 (b) An absentee ballot received by the clerk after
17 the meeting of the county canvassing board shall not be
18 voted. The clerk shall write on the inner envelope of such
19 late absentee ballot "Rejected-received after the polls
20 closed meeting of the county canvassing board". These late
21 ballots shall be kept by the clerk for at least two (2)
22 years after the election or longer if required by federal
23 law and then destroyed.

2 22-16-103. County canvass procedures.

4 (c) The county canvassing board shall:
5
6 (i) Meet as soon as all returns have been
7 received and abstracted, but if any provisional ballots
8 have been cast in the county, not before the time has
9 passed for provisional voters to document their eligibility
10 to register or to vote. The board shall meet at a time and
11 place designated by the county clerk, but no later than on
12 the first Friday following the election;

14 Section 2. This act is effective July 1, 2024.
