A BILL
for
1 AN ACT relating to trade and commerce; prohibiting the
2 categorization of firearms and ammunition merchants
3 separately from general merchandise or sporting goods
4 retailers as specified; creating a penalty; and providing
5 for an effective date.

7 Be It Enacted by the Legislature of the State of Wyoming:

9 Section 1. W.S. 40-32-101 is created to read:

3 40-32-101. Purchase of firearms and ammunition
4 protections; merchant code limitations; enforcement.

6 (a) A payment settlement entity, merchant acquiring
7 entity, or third party settlement organization as those
8 terms are defined in section 6050W of the Internal Revenue
9 Code shall not assign a merchant category code to or
10 otherwise classify a merchant that is a seller of firearms
11 or ammunition separately from general merchandise retailers
12 or sporting goods retailers.

14 (b) An entity involved in facilitating or processing
15 a payment card transaction, including, but not limited to,
16 a financial institution, an acquirer, a payment card
17 network or a payment card issuer, shall not assign to or
18 require a merchant to use a merchant category code that
19 classifies the merchant as a firearms or ammunition
20 retailer or places the merchant in a similar
21 classification. A merchant of firearms or ammunition may be
22 assigned or may use a merchant category code for general
23 merchandise retailers or sporting goods retailers.

2 (c) Any person who violates this section is guilty of
3 a misdemeanor punishable by a fine of one thousand dollars
4 ($1,000.00) for every one (1) merchant category code
5 assigned to a merchant in violation of this section or for
6 each instance that a person is classified as a firearms
7 retailer in violation of this section.

9 Section 2. This act is effective July 1, 2024.
