A BILL
for
1 AN ACT relating to civil procedure; extending the statute
2 of limitations for causes of action for gender transition
3 services performed on minors; providing definitions;
4 specifying applicability; and providing for an effective
5 date.

7 Be It Enacted by the Legislature of the State of Wyoming:
8
9 Section 1. W.S. 1-3-105 by creating a new subsection
10 (c) is amended to read:

1 1-3-105. Actions other than recovery of real
2 property.

4 (c) Notwithstanding subsection (a) of this section or
5 W.S. 1-3-107, a civil action based upon an act, error or
6 omission against a minor in the provision of gender
7 transition services shall be brought not later than the
8 minor's twenty-first birthday. For purposes of this
9 subsection:
10
11 (i) "Cross-sex hormones" means testosterone,
12 estrogen or progesterone given to a person in an amount
13 greater than would normally be produced endogenously in a
14 healthy person of that person's age and sex;
15
16 (ii) "Gender" means the psychological,
17 behavioral, social and cultural aspects of being male or
18 female;
19
20 (iii) "Gender reassignment surgery" means any
21 medical or surgical service that seeks to surgically alter
22 or remove healthy physical or anatomical characteristics or
23 features that are typical for the person's sex, in order to

1 instill or create physiological or anatomical
2 characteristics that resemble a sex different from the
3 person's sex, including without limitation, genital or
4 nongenital gender reassignment surgery performed for the
5 purpose of assisting a person with a gender transition;
6
7 (iv) "Gender transition" means the process in
8 which a person goes from identifying with and living as a
9 gender that corresponds to his sex to identifying with and
10 living as a gender different from his sex, and may involve
11 social, legal or physical changes;
12
13 (v) "Gender transition service" means any
14 medical or surgical service, including without limitation
15 physician's services, inpatient and outpatient hospital
16 services, puberty-blocking drugs, cross-sex hormones or
17 genital or nongenital gender reassignment surgery, provided
18 or performed for the purpose of assisting a person with a
19 physical gender transition;

21 (vi) "Genital gender reassignment surgery" means
22 a medical procedure performed for the purpose of assisting

1 a person with a physical gender transition, including
2 without limitation:

4 (A) Surgical procedures such as a
5 penectomy, orchiectomy, vaginoplasty, clitoroplasty, or
6 vulvoplasty for biologically male patients; or
7
8 (B) Surgical procedures such as a
9 hysterectomy, oophorectomy, reconstruction of the urethra,
10 metoidioplasty or phalloplasty, vaginectomy, scrotoplasty,
11 or implantation of erection or testicular prostheses for
12 biologically female patients.

14 (vii) "Nongenital gender reassignment surgery"
15 means medical procedures performed for the purpose of
16 assisting a person with a physical gender transition,
17 including without limitation:
18
19 (A) Surgical procedures for biologically
20 male patients, such as augmentation mammoplasty, facial
21 feminization surgery, liposuction, lipofilling, voice
22 surgery, thyroid cartilage reduction, gluteal augmentation,
23 hair reconstruction or various aesthetic procedures; or

2 (B) Surgical procedures for biologically
3 female patients, such as subcutaneous mastectomy, voice
4 surgery, liposuction, lipofilling, pectoral implants or
5 various aesthetic procedures.

7 (viii) "Puberty-blocking drugs" means
8 gonadotropin releasing hormone analogues or other synthetic
9 drugs used to stop luteinizing hormone and follicle
10 stimulating hormone secretion, synthetic antiandrogen drugs
11 used to block the androgen receptor, or any drug to
12 suppress or delay normal pubertal development in children;
13
14 (ix) "Sex" means the biological indication of
15 male and female in the context of reproductive potential or
16 capacity, such as sex chromosomes, naturally occurring sex
17 hormones, gonads and nonambiguous internal and external
18 genitalia present at birth, without regard to a person's
19 psychological, chosen or subjective experience of gender.

21 Section 2. This act applies to causes of action
22 arising on and after July 1, 2024.
