State land exchanges-public notice.

A BILL
for
1 AN ACT relating to state lands; requiring the submittal of
2 an application for any proposed land exchange to the board
3 of land commissioners; requiring the board to provide
4 public notice for any proposed land exchange; requiring
5 rulemaking; specifying applicability; and providing for
6 effective dates.

8 Be It Enacted by the Legislature of the State of Wyoming:

10 Section 1. W.S. 36-1-111 by creating a new subsection
11 (b) is amended to read:
12
13 36-1-111. Orders, rules and regulations relative to
14 exchange of lands; public notice.

1 (b) Any person including any government, political
2 subdivision of a government, governmental agency or local
3 governmental agency desiring to propose lands to be
4 exchanged under this act shall file with the board of land
5 commissioners an application on a form approved by the
6 board that shall be accompanied by documentation evidencing
7 the value of the lands proposed to be exchanged in
8 compliance with the valuation requirements under subsection
9 (a) of this section. The board may request any additional
10 information as specified by rule of the board. Upon receipt
11 of any land exchange application under this subsection and
12 before implementing an exchange of the proposed lands, the
13 board shall conspicuously post notice of the proposed land
14 exchange on the board's official website subject to the
15 following requirements the notice shall:

17 (i) Be posted upon determination of the director
18 to proceed with the proposed land exchange and when the
19 board receives the land exchange application required under
20 this subsection. The notice shall remain posted until the
21 board takes final action on the proposed land exchange; and

1 (ii) Specify the process through which members
2 of the public can obtain additional information and comment
3 on the land exchange proposal.

5 Section 2. This act shall apply to all land exchanges
6 proposed on and after July 1, 2024.

8 Section 3. The board of land commissioners shall
9 promulgate all rules necessary to implement this act.

11 Section 4.

13 (a) Except as otherwise provided in subsection (b) of
14 this section, this act is effective July 1, 2024.
15
16 (b) Sections 3 and 4 of this act are effective
17 immediately upon completion of all acts necessary for a
18 bill to become law as provided by Article 4, Section 8 of
19 the Wyoming Constitution.
