Pharmacy benefit manager amendments.

A BILL
for
1 AN ACT relating to pharmacy benefit managers; amending
2 provisions related to pharmacies and in network retail
3 pharmacies; requiring rulemaking; specifying applicability;
4 and providing for effective dates.

6 Be It Enacted by the Legislature of the State of Wyoming:

8 Section 1. W.S. 26-52-105 by creating a new
9 subsection (d) is amended to read:
10
11 26-52-105. Transparency; prohibitions.
12
13 (d) A person's choice of in network provider shall
14 include a retail pharmacy. The department of insurance
15 shall promulgate rules regarding network adequacy of in

1 network retail pharmacies and pharmacy location. An insurer
2 or pharmacy benefit manager shall not use discounts in cost
3 sharing or a reduction in a copay or the number of copays
4 to incentivize a person's choice of in network pharmacy.

6 Section 2. The department of insurance shall
7 promulgate all rules necessary to implement this act.
8
9 Section 3. This act shall apply to prescription drugs
10 dispensed on or after the effective date of this act.

12 Section 4.

14 (a) Except as otherwise provided by subsection (b) of
15 this section, this act is effective January 1, 2025.
16
17 (b) Sections 2 and 4 of this act are effective
18 immediately upon completion of all acts necessary for a
19 bill to become law as provided by Article 4, Section 8 of
20 the Wyoming Constitution.
