A BILL
for
1 AN ACT relating to the protection of constitutional rights;
2 declaring legislative authority; prohibiting the
3 implementation or enforcement of an extreme risk protection
4 order; preempting local law; providing definitions; and
5 providing for an effective date.

7 Be It Enacted by the Legislature of the State of Wyoming:
8
9 Section 1. W.S. 9-14-301 and 9-14-302 are created to
10 read:

1 9-14-301. Short title.

3 This article shall be known and may be cited as the
4 "Protect Firearms Rights Act."
5
6 9-14-302. Prohibiting the implementation or
7 enforcement of an extreme risk protection act; preempting
8 local law; definitions.

10 (a) For purposes of this act:
11
12 (i) "Extreme risk protection order" means any
13 executive order, written order or warrant issued by a court
14 or signed by a magistrate or other officer of the court,
15 for which the primary or intended purpose is to prevent a
16 specific person, deemed to be a danger to themselves or
17 others, from accessing firearms or ammunition by doing one
18 (1) or more of the following:

20 (A) Prohibiting a specific person from
21 owning, possessing, using, purchasing, manufacturing or
22 receiving a firearm or ammunition;

1 (B) Removing a firearm or ammunition from
2 the possession or control of a specific person or requiring
3 a specific person to surrender any firearms or ammunition
4 the person owns, possesses or controls.

6 (ii) "Extreme risk protection order" shall not
7 mean and does not include an order of protection issued
8 pursuant to W.S. 7-3-506 et seq., W.S. 35-21-101 et seq. or
9 an order for involuntary hospitalization of a mentally ill
10 person issued pursuant to W.S. 25-10-101 et seq.;

12 (iii) "This act" means W.S. 9-14-301 and
13 9-14-302.

15 (b) This act shall preempt any local law, ordinance
16 or regulation regarding an extreme risk protection order or
17 any other law, ordinance or regulation that may conflict
18 with any provision of this act.

20 (c) The state of Wyoming and all political
21 subdivisions of this state are prohibited from using any
22 personnel or funds appropriated by the legislature of the
23 state of Wyoming or any other source of funds that

1 originated within or outside the state of Wyoming to
2 implement any statute, rule, executive order, judicial
3 order or judicial finding that would have the effect of
4 enforcing an extreme risk protection order against or upon
5 a resident of the state.

7 Section 2. This act is effective July 1, 2024.
