Newborn safety device funding for safe haven providers.

A BILL
for
1 AN ACT relating to safety for a newborn child; providing
2 grants for safe haven providers to purchase newborn safety
3 devices as specified; providing a definition; requiring
4 rulemaking; providing an appropriation; and providing for
5 effective dates.

7 Be It Enacted by the Legislature of the State of Wyoming:

9 Section 1.

11 (a) For purposes of this act, "newborn safety device"
12 means a device installed at a safe haven provider, as
13 defined by W.S. 14-11-102(a)(vii), where a newborn child
14 can be safely placed and that alerts the personnel of the

1 safe haven provider that a newborn child has been placed in
2 the device.

4 (b) The department of family services shall establish
5 and administer a temporary grant program for the purpose of
6 providing grants for safe haven providers to purchase
7 newborn safety devices. The safe haven providers who
8 receive grants shall manage the newborn safety devices.
9 Each safe haven provider shall receive not more than one
10 (1) grant and one (1) newborn safety device.

12 (c) The department of family services shall develop
13 an application process for safe haven providers to receive
14 grants to purchase newborn safety devices and shall review
15 applications to determine eligibility. Any safe haven
16 provider may apply for a grant under this section pursuant
17 to the application process established by the department of
18 family services.

20 (d) The temporary grant program shall terminate June
21 30, 2025. Applications shall be received not later than
22 March 1, 2025. No grants shall be awarded under this
23 section after June 30, 2025.

2 Section 2. The department of family services shall
3 promulgate all rules necessary to implement this act.

5 Section 3. There is appropriated three hundred
6 thousand dollars ($300,000.00) from the general fund to the
7 department of family services for purposes of implementing
8 this act. This appropriation shall be for the period
9 beginning July 1, 2024 and ending June 30, 2025. This
10 appropriation shall only be used to make grants for
11 purchasing newborn safety devices, except that one percent
12 (1%) of this appropriation may be used for administrative
13 expenses incurred pursuant to this act. This appropriation
14 shall not be transferred or expended for any other purpose
15 and any unexpended, unobligated funds remaining from this
16 appropriation on June 30, 2025 shall revert as provided by
17 law.

3 (a) Except as otherwise provided by subsection (b) of
4 this section, this act is effective July 1, 2024.
5
6 (b) Sections 2 and 4 of this act are effective
7 immediately upon completion of all acts necessary for a
8 bill to become law as provided by Article 4, Section 8 of
9 the Wyoming Constitution.
