A BILL
for
1 AN ACT relating to education; imposing requirements for
2 rental fees charged by school districts for use of school
3 district property as specified; and providing for an
4 effective date.

6 Be It Enacted by the Legislature of the State of Wyoming:

8 Section 1. W.S. 21-3-111(a)(ii) is amended to read:
9
10 21-3-111. Powers of boards of trustees.
11
12 (a) The board of trustees in each school district
13 within the state may:

1 (ii) Acquire, hold, convey, lease, rent, and
2 manage property, real and personal, for the benefit of the
3 school district in the name by which the district is
4 designated, either alone or jointly with another public or
5 private agency, institution, person, or corporation. This
6 includes leasing of real property under W.S. 21-15-112. Any
7 rental fees charged by the district for use of school
8 district property shall:

10 (A) Not exceed the direct incremental costs
11 incurred by the district for the specific use of the
12 property during each rental period after considering the
13 district's fixed costs to maintain the property without the
14 requested rental use of the property;
15
16 (B) Be supported by an itemized statement
17 of the district's direct incremental costs for the specific
18 use of the property during each rental period; and
19
20 (C) Be uniform for the same or similar use
21 of the property.
