A BILL
for
1 AN ACT relating to the administration of the government;
2 creating an account; providing for the funding of the peace
3 officer standards and training commission; specifying uses
4 of the account; increasing vehicle registration fees as
5 specified; specifying distribution of fees; making
6 conforming amendments; and providing for an effective date.

8 Be It Enacted by the Legislature of the State of Wyoming:
9
10 Section 1. W.S. 9-1-712 is created to read:
11
12 9-1-712. Peace officer standards and training
13 commission account; expenditures.

1 (a) There is created the peace officer standards and
2 training commission account. Funds in the account shall be
3 invested by the state treasurer in accordance with law,
4 provided that the investments are made to ensure sufficient
5 liquidity for the commission to implement this act. The
6 account shall consist of all funds and earnings deposited
7 into the account from whatever source.

9 (b) No funds shall be expended from the account
10 except upon legislative appropriation. Funds in the account
11 shall be expended only by the commission for purposes of
12 implementing this act.

14 Section 2. W.S. 9-1-701(a)(xii), 31-3-101(a) by
15 creating a new paragraph (iv) and by renumbering (iv) as
16 (v), 31-3-103 by creating a new subsection (n),
17 31-18-401(a) by creating a new paragraph (iv) and 31-18-406
18 by creating a new subsection (e) are amended to read:

22 (a) As used in this act:

1 (xii) "This act" means W.S. 9-1-701 through
2 9-1-711 9-1-712;

4 31-3-101. Registration fees; exemptions.
5
6 (a) Except as otherwise provided, the following fees
7 shall accompany each application for the registration of a
8 vehicle:
9
10 (iv) In addition to any fee required under this
11 subsection, a peace officer standards and training fee of
12 one dollar ($1.00) for each vehicle for distribution in
13 accordance with W.S. 31-3-103(n);
14
15 (iv)(v) As used in this subsection, "special
16 equipment value" shall not include any value from an
17 assistive device.

19 31-3-103. Distribution of fees; refunds.
20
21 (n) Fees collected pursuant to W.S. 31-3-101(a)(iv)
22 shall be distributed to the state treasurer for deposit in
23 the peace officer standards and training commission

1 account, except as otherwise provided in this subsection. A
2 county treasurer may retain not greater than five percent
3 (5%) of all fees collected pursuant to W.S. 31-3-101(a)(iv)
4 in the county for purposes of administering the fee
5 required in W.S. 31-3-101(a)(iv).

7 31-18-401. Registration fees.

9 (a) Except as otherwise provided, the following fees
10 shall accompany each application for the registration of a
11 commercial vehicle:

13 (iv) In addition to any fee required under this
14 subsection, a peace officer standards and training fee of
15 one dollar ($1.00) for each vehicle for distribution in
16 accordance with W.S. 31-18-406(e).

20 (e) Fees collected pursuant to W.S. 31-18-401(a)(iv)
21 shall be distributed to the state treasurer for deposit in
22 the peace officer standards and training commission
23 account, except as otherwise provided in this subsection.

1 The department may retain not greater than five percent
2 (5%) of all fees collected pursuant to W.S.
3 31-18-401(a)(iv) for deposit in the state highway fund for
4 purposes of administering the fee required by W.S.
5 31-18-401(a)(iv).

7 Section 3. This act is effective July 1, 2024.
