State funded capital construction.

A BILL
for
1 AN ACT relating to state funded capital construction; providing
2 definitions; providing appropriations for purposes related to
3 state funded capital construction; making appropriations subject
4 to terms and conditions as specified; providing matching funds for
5 specified projects; providing for the acquisition or acceptance of
6 real property; authorizing the expenditure of prior appropriations
7 as specified; reverting a prior appropriation; and providing for
8 an effective date.

10 Be It Enacted by the Legislature of the State of Wyoming:
11
12 Section 1.
13
14 (a) As used in this act:

1 (i) "Appropriation" means the authorizations granted by
2 the legislature under this act to make expenditures from and to
3 incur obligations against the general and other funds as specified;
4
5 (ii) "FF" means federal funds;
6
7 (iii) "PR" means private funding sources;
8
9 (iv) "SR" means an agency's account within the special
10 revenue fund;
11
12 (v) "S0" means other funds identified by footnote;
13
14 (vi) "S13" means the strategic investments and projects
15 account.
16
17 (b) Appropriations for projects in this act remain in effect
18 until the project is completed, unless otherwise provided. The
19 amounts appropriated for projects under this act shall be expended
20 only on the projects specified and any unexpended, unobligated
21 funds remaining upon completion of a project shall revert to the
22 accounts from which they were appropriated, unless otherwise
23 provided. The amounts appropriated in this act are intended to

1 provide a maximum amount for each project from any source excluding
2 contingency funding and shall not be construed to be an entitlement
3 or guaranteed amount.

5 (c) When used in a footnote in this act, "this appropriation"
6 shall be construed as a reference to that portion of the
7 appropriated funds identified in the footnote.

11 Section 2.

1 2. (a) This appropriation is for level I and II studies for the following
2 projects:

4 (i) Department of administration and information - combined
5 laboratories facility renovation;
6
7 (ii) Department of agriculture - dairy barn;
8
9 (iii) Department of administration and information - master plan
10 studies for state facilities outside of Cheyenne;
11
12 (iv) Department of agriculture - master plan follow-up.

14 (b) Notwithstanding any other provision of law, after funds are obligated
15 for all studies specified in subsection (a) of this footnote, any remaining
16 unobligated funds from this appropriation are authorized for expenditure on any
17 level I or II master plan studies approved by the state building commission.
18
19 3. This appropriation is for purposes of the Riverton state office building
20 renovation project. This appropriation is contingent upon the acquisition of an
21 office building by the state for the Riverton state office building project.
22 Funds from this appropriation shall be prioritized for the renovation of the
23 second floor of the office building prior to any other expenditures.

1 4. This appropriation shall be reduced by one dollar ($1.00)S13 for each one

1 Section 3. From any unexpended, unobligated monies
2 appropriated from the Wyoming state hospital demolition account
3 for purposes of the demolition and abatement of unused or abandoned
4 facilities on the campus of the Wyoming state hospital under 2023
5 Wyoming Session Laws, Chapter 187, Section 5(a)(i), Section 027,
6 Footnote 3, up to three million four hundred twenty-nine thousand
7 five hundred seventy-four dollars ($3,429,574.00), or as much
8 thereof as is available, is hereby reappropriated to the department
9 of health for purposes of demolition of two (2) storage buildings
10 and replacement of a storage building.

12 [GILLETTE COMMUNITY COLLEGE DISTRICT PROPERTY TRANSFER I]

14 Section 4. The Gillette community college district is
15 authorized to acquire or accept the transfer of ownership from the
16 city of Gillette of five (5) facilities totaling approximately
17 seventy-eight thousand six hundred fifty-three (78,653) square
18 feet consisting of the carter health science center, tanner village
19 1, tanner village 2, tanner village 3 and inspiration hall. To the
20 extent these facilities qualify and are owned by the Gillette
21 community college district, the square footage of the acquired or
22 transferred facilities shall be included within the computation of
23 major maintenance budget requests submitted in accordance with

5 Section 5. The Gillette community college district is
6 authorized to acquire or accept the transfer of ownership from the
7 northern Wyoming community college district of six (6) facilities
8 totaling approximately two hundred twelve thousand seven hundred
9 ninety-eight (212,798) square feet consisting of technical
10 education center A, technical education center B, pronghorn
11 center, tanner village 4, high plains grill and Gillette college
12 agricultural complex. To the extent these facilities qualify and
13 are owned by the Gillette community college district, the square
14 footage of the acquired or transferred facilities shall be included
15 within the computation of major maintenance budget requests
16 submitted in accordance with W.S. 21-18-225.

20 Section 6. Any unexpended, unobligated monies appropriated
21 from the general fund to the state construction department for
22 purposes of the Riverton State Office under 2023 Wyoming Session
23 Laws, Chapter 187, Section 5(a)(i), Section 027 is hereby

1 reappropriated to the state construction department for purposes
2 of the Riverton state office building renovation project.

4 [RECREATION CENTER CAPITAL CONSTRUCTION GRANT]

6 Section 7.

8 (a) There is appropriated three million five hundred
9 thousand dollars ($3,500,000.00) from the strategic investments
10 and projects account to the office of state lands and investments
11 for purposes of providing a grant to the city of Riverton for a
12 recreation center for sports activities that shall serve all of
13 Fremont County, subject to the following conditions:
14
15 (i) The city of Riverton shall secure matching funds in
16 the ratio of one dollar ($1.00) of grant funds to not less than
17 one dollar ($1.00) from any other source;
18
19 (ii) No grant funds shall be awarded unless the city of
20 Riverton has secured matching funds for the entire cost of the
21 project;

1 (iii) This appropriation shall lapse and revert if
2 matching funds are not secured within twenty-four (24) months after
3 the effective date of this section;

5 (iv) The city of Riverton shall provide oversight and
6 management of the expenditure of grant funds and shall hold
7 ownership of the recreation center.

11 Section 8. From any unexpended, unobligated monies
12 appropriated from the strategic investments and projects account
13 for the central Wyoming college Jackson outreach center under 2022
14 Wyoming Session Laws, Chapter 49, Section 4(a)(i), Section 027,
15 ten million three hundred thirty-five thousand four hundred
16 seventy-eight dollars ($10,335,478.00)S13, or as much thereof as
17 is available, are hereby reverted to the strategic investments and
18 projects account.
