Wyoming Underground Facilities Notification Act-exemption.

A BILL
for
1 AN ACT relating to the Wyoming Underground Facilities
2 Notification Act; providing an exemption from notice
3 requirements for specified agricultural activities; and
4 providing for an effective date.

6 Be It Enacted by the Legislature of the State of Wyoming:

8 Section 1. W.S. 37-12-305 by creating a new
9 subsection (k) is amended to read:
10
11 37-12-305. Exemptions.
12
13 (k) The following agricultural activities of a farmer
14 or rancher occurring on a farm or ranch are exempt from the
15 provisions of this act:

2 (i) Any form of existing agricultural activity
3 that is routine for the farm or ranch;
4
5 (ii) Land clearing that does not involve deep
6 ripping or deep root removal of trees or shrubs;
7
8 (iii) Routine maintenance of an existing
9 irrigation facility if the facility has been subjected to
10 maintenance in the previous twenty-four (24) months;
11
12 (iv) Routine maintenance of existing fence
13 lines.

15 Section 2. This act is effective July 1, 2024.
