Right of health care access-constitutional amendment.

A JOINT RESOLUTION
for
1 A JOINT RESOLUTION proposing to amend the Wyoming
2 Constitution to eliminate the legislature's express authority
3 to determine reasonable and necessary restrictions on a
4 person's right to make health care decisions and to direct
5 payment for health care.

7 BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF WYOMING,
8 two-thirds of all the members of the two houses, voting
9 separately, concurring therein:

11 Section 1. The following amendment to the Wyoming
12 Constitution is proposed for submission to the electors of
13 the State of Wyoming at the next general election for approval
14 or rejection to become valid as a part of the Constitution if
15 ratified by a majority of the electors at the election. The

1 amendment is to repeal Article 1, Section 38(c) of the Wyoming
2 Constitution.

4 Section 2. That the Secretary of State shall endorse
5 the following statement on the proposed amendment:

7 The Wyoming Constitution currently provides that each
8 competent adult has the right to make his or her own health
9 care decisions, a right that the state must act to preserve
10 from undue governmental infringement. The adoption of this
11 amendment would expand the existing individual right of
12 health care access and decision-making by eliminating the
13 legislature's express authority to determine reasonable and
14 necessary restrictions on a person's right to make health
15 care decisions and to direct payment for health care.
