A BILL
for
1 AN ACT relating to motor vehicles; imposing a time period
2 for the department of transportation to downgrade a
3 commercial driver's license; requiring the department of
4 transportation to reinstate commercial driver's licenses
5 previously downgraded as specified; requiring rulemaking;
6 and providing for effective dates.

8 Be It Enacted by the Legislature of the State of Wyoming:

10 Section 1. W.S. 31-7-305(o) is amended to read:
11
12 31-7-305. Disqualification and cancellation; right to
13 a hearing.

1 (o) A person may be disqualified from driving a
2 commercial motor vehicle, or the department may downgrade a
3 person's commercial driver's license to a noncommercial
4 driver's license, if the person fails to provide a current
5 federal medical qualification certificate when requested by
6 within sixty (60) days after the expiration of the federal
7 medical qualification certificate on file with the
8 department. The department shall reinstate a commercial
9 driver's license that was previously downgraded under this
10 subsection without requiring the person to take the
11 knowledge and driving tests under W.S. 31-7-114 upon the
12 person providing a current federal medical qualification
13 certificate before the original expiration date of the
14 commercial driver's license.

16 Section 2. The department of transportation shall
17 promulgate any rules necessary to implement this act.

1 Section 3.

3 (a) Except as provided in subsection (b) of this
4 section, this act is effective July 1, 2024.
5
6 (b) Sections 2 and 3 of this act are effective
7 immediately upon completion of all acts necessary for a
8 bill to become law as provided by Article 4, Section 8 of
9 the Wyoming Constitution.
