Health care providers-submission of insurance claims.

A BILL
for
1 AN ACT relating to the insurance code; requiring health
2 care providers to be responsible for tendering insurance
3 claims to health insurance companies as specified;
4 prohibiting terms between a health care provider and a
5 patient that require the patient to tender the insurance
6 claim; providing applicability; and providing for an
7 effective date.

9 Be It Enacted by the Legislature of the State of Wyoming:

11 Section 1. W.S. 26-15-136 by creating a new
12 subsection (c) is amended to read:

1 26-15-136. Assignment of insurance proceeds to
2 doctor, hospital or state agency; lien for state care;
3 notice of lien.

5 (c) In any accepted assignment of benefits under
6 subsections (a) or (b) of this section, the assignee shall
7 have the responsibility to submit the claim for benefits
8 due under the contract to the relevant third party agency
9 or insurer. If an assignee accepts an assignment of
10 benefits, the assignee shall not require the beneficiary to
11 be responsible for submitting the claim to the relevant
12 third party agency or insurer. In the event an assignee
13 fails to submit the claim in a timely or complete manner,
14 the risk of nonpayment shall be borne by the assignee and
15 the assignee shall have no recourse against the
16 beneficiary, applicant or recipient.

18 Section 2. This act applies to assignments of
19 benefits initiated on or after July 1, 2024.
20
21 Section 3. This act is effective July 1, 2024.
