The bill authorizes county clerks in Wyoming to reject or notate frivolous filings, establishing specific procedures for doing so. It defines "filing" as any document submitted to the county clerk, excluding conveyances and liens, and defines "frivolous" as lacking a legitimate legal or factual basis or being intended for improper purposes, such as harassment. If a county clerk suspects a filing may be frivolous, they can hold it in abeyance and must file a motion with the district court for a determination. If the court finds the filing frivolous, the clerk can reject it and must refund any fees collected within ten days. Additionally, clerks can review previously filed documents and seek to notate those deemed frivolous by the court.
The bill also stipulates that any filing declared frivolous by the district court will have no legal effect. The effective date for this act is set for July 1, 2024.
