Public officer fiscal training-amendments.

A BILL
for
1 AN ACT relating to administration of the government;
2 limiting the duration of the minimum training requirements
3 for public officers; authorizing public officers to satisfy
4 minimum training requirements through a virtual format;
5 providing that a public officer failure to comply with the
6 minimum training requirements is not cause for
7 recommendation for removal from office; and providing for
8 an effective date.

10 Be It Enacted by the Legislature of the State of Wyoming:
11
12 Section 1. W.S. 9-1-510(a)(intro) is amended to read:
13
14 9-1-510. Instructions to public officers; failure of
15 public officer to obey.

2 (a) The director of the state department of audit
3 shall establish minimum training requirements for public
4 officers. The minimum training requirements shall not
5 exceed four (4) hours and the minimum training requirements
6 may be completed in a virtual format on the public
7 officer's personal time. The department of audit shall
8 promulgate rules to effectuate this paragraph. The director
9 shall instruct public officers in the proper handling of
10 the accounts of their offices in accordance with the
11 minimum training requirements established by the director
12 and provide comprehensive written materials. In lieu of
13 directly instructing public officers, the director may
14 develop and maintain a list of approved courses that comply
15 with the minimum training requirements. All public officers
16 shall receive instruction in accordance with the minimum
17 training requirements established by the director within
18 one (1) year of assuming office or assuming responsibility
19 for handling the accounts of their office. The director may
20 waive or modify the requirement for public officers to
21 receive instruction within one (1) year of assuming office
22 or responsibility for handling the accounts of their office
23 if no approved courses exist in either a virtual format or

1 within the state, or if available courses are cost
2 prohibitive. A public officer shall handle the accounts of
3 his office strictly in conformance with the instructions of
4 the director or any approved course and in the manner
5 required by law. If any public officer willfully neglects
6 or refuses to handle his accounts in the manner required,
7 or fails to comply with the minimum training requirements
8 established by the director within one (1) year of assuming
9 office, the director may request the governing body with
10 oversight over the public officer or other appropriate
11 authority to remove the public officer or provide increased
12 oversight. For purposes of this section, a "public officer"
13 shall be defined as:
