Prohibition on private funds for conducting elections.

A BILL
for
1 AN ACT relating to elections; prohibiting government
2 officials and election officials from soliciting, taking or
3 otherwise accepting private funds to conduct elections as
4 specified; providing for an exception for special
5 districts; creating a new misdemeanor offense; and
6 providing for an effective date.

8 Be It Enacted by the Legislature of the State of Wyoming:

10 Section 1. W.S. 22-2-123 is created to read:
11
12 22-2-123. Private funds in elections prohibited.

14 (a) Notwithstanding any other provision of law, no
15 government official or election official in Wyoming shall

1 solicit, take or otherwise accept from any person any
2 contribution, donation or anything of value for purposes of
3 conducting an election. All costs and expenses relating to
4 elections shall be paid with public funds. This subsection
5 shall not apply to meals or food provided or donated in
6 support of election training or education and meals or food
7 provided on election day to poll workers and other election
8 staff. The secretary of state may by rule exempt any
9 particular class of special district elections from all or
10 a portion of this subsection.

12 (b) Nothing in this section shall be construed to
13 prohibit the acceptance and expenditure of federal funds
14 for elections as provided by law.

16 Section 2. This act is effective July 1, 2024.
