Certificate of need repeal.

A BILL
for
1 AN ACT relating to public health and safety; authorizing
2 the department of health to comment on alterations or
3 additions to health care facilities rather than approve
4 these plans; repealing bed expansion limitations for
5 nursing care facilities and hospitals as specified; making
6 conforming amendments; and providing for an effective date.

8 Be It Enacted by the Legislature of the State of Wyoming:

10 Section 1. W.S. 35-2-906(a) is amended to read:
11
12 35-2-906. Construction and expansion of facilities;
13 exemption.

1 (a) A licensee who contemplates construction of or
2 alteration or addition to a health care facility shall
3 submit plans and specifications to the division for
4 preliminary inspection and approval comment prior to
5 commencing construction. Significant changes to the
6 original plans must also be submitted and approved
7 commented on prior to implementation. The plans and any
8 changes shall indicate any increase in the number of beds.

10 Section 2. W.S. 35-2-901(a)(v) and 35-2-906(b), (c),
11 (f) and (g) are repealed.

13 Section 3. This act is effective July 1, 2024.
