Military department emergency fire suppression account.

A BILL
for
1 AN ACT relating to the military department; creating an
2 account for emergency fire suppression costs on all state
3 lands managed by the military department; authorizing the
4 adjutant general to expend monies for emergency fire
5 suppression; requiring rulemaking; providing an
6 appropriation; and providing for an effective date.

8 Be It Enacted by the Legislature of the State of Wyoming:

10 Section 1. W.S. 19-7-210 is created to read:
11
12 19-7-210. Military department emergency fire
13 suppression account; creation; investment of funds;
14 authorized expenditures; rulemaking.

1 (a) As used in this section, "emergency fire" means a
2 fire burning on or originating on any state lands managed
3 by the military department that is or clearly threatens to
4 be, beyond the fire control resources of the military
5 department.

7 (b) There is created the military department
8 emergency fire suppression account. The account shall
9 include all legislative appropriations and all funds
10 deposited to the account by the military department. The
11 military department may accept funds including donations,
12 gifts, bequests, devises and grants for the account and
13 shall deposit any received funds in the account.
14 Notwithstanding W.S. 9-2-1008, 9-2-1012(e) or 9-4-207,
15 unobligated and unexpended funds in the account shall not
16 lapse or revert and shall remain available for distribution
17 as provided in this section.

19 (c) Any unexpended balance in the account shall be
20 invested by the state treasurer and the investment earnings
21 shall be credited to the general fund.

1 (d) Funds appropriated by the legislature for
2 emergency fire suppression on state lands managed by the
3 military department shall be deposited into the account.
4 All funds in the account are continuously appropriated for
5 contracts and other expenses authorized under this section.

7 (e) Upon written approval of the adjutant general,
8 expenditures shall be made out of the account for the
9 actual costs of suppressing emergency fires on state lands
10 managed by the military department.

12 (f) If the adjutant general determines that monies in
13 the account may be insufficient to fully reimburse the
14 costs of suppressing all emergency fires occurring or which
15 may occur during the year, the adjutant general may delay
16 paying reimbursement to any entity until the close of the
17 program year at which time available monies shall be
18 prorated among those entities entitled to reimbursement.

20 Section 2. The military department shall promulgate
21 all rules necessary to implement this act.

1 Section 3. There is appropriated two million dollars
2 ($2,000,000.00) from the general fund to the military
3 department emergency fire suppression account created in
4 Section 1 of this act. This appropriation shall be for the
5 period beginning with the effective date of this act. This
6 appropriation shall not be transferred or expended for any
7 other purpose. Notwithstanding W.S. 9-2-1008, 9-2-1012(e)
8 and 9-4-207, this appropriation shall not revert.

10 Section 4. This act is effective July 1, 2024.
