A BILL
for
1 AN ACT relating to children; repealing a provision
2 authorizing specified minors to consent to tobacco
3 cessation treatment; and providing for an effective date.

5 Be It Enacted by the Legislature of the State of Wyoming:

7 Section 1. W.S. 14-1-101(b)(vi) is repealed.

13 For reference, W.S. 14-1-101(b)(vi) states: "A minor may
14 consent to health care treatment to the same extent as if
15 he were an adult when any one (1) or more of the following
16 circumstances apply: . . . The minor is twelve (12) years
17 of age or older, is a smoker or user of tobacco products

1 and the health care to which the minor consents is a
2 tobacco cessation program approved by the department of
3 health pursuant to W.S. 9-4-1204." In turn, W.S. 9-4-1204
4 requires the Department of Health to "develop and implement
5 comprehensive tobacco prevention, cessation and treatment
6 programs for Wyoming" using funds from the income account
7 within the Wyoming Tobacco Settlement Trust Fund. W.S. 9-4-
8 1204(a).
