A BILL
for
1 AN ACT relating to public utilities; providing for the
2 review of integrated resource plan action plans by the
3 public service commission; providing rulemaking authority;
4 and providing for an effective date.

6 Be It Enacted by the Legislature of the State of Wyoming:
7
8 Section 1. W.S. 37-2-135 is created to read:
9
10 37-2-135. Review of integrated resource plan action
11 plans.

1 (a) The commission shall engage in long-range
2 planning regarding public utility regulatory policy in
3 order to facilitate the well-planned development and
4 conservation of utility resources. Pursuant to this
5 subsection, the commission shall require each affected
6 electrical utility to file any action plan developed as
7 part of the affected electrical utility's integrated
8 resource plan to enable the commission to review and
9 provide guidance to the affected electrical utility.

11 (b) The commission shall adopt rules providing a
12 process for the review and acknowledgement of an action
13 plan and integrated resource plan under subsection (a) of
14 this section. The rules shall:
15
16 (i) Provide that the review shall be conducted
17 in accordance with the commission's rules of contested case
18 practice and procedures;
19
20 (ii) Require the commission to determine whether
21 the action plan and integrated resource plan should be
22 acknowledged;

1 (iii) Authorize the commission to provide
2 guidance to the affected electrical utility regarding the
3 action plan and integrated resource plan;
4
5 (iv) Specify that acknowledgment of an action
6 plan and integrated resource plan does not include a
7 determination of prudence or a presumption of rate
8 recovery;
9
10 (v) Specify that the affected electrical utility
11 is permitted flexibility to make changes in an action plan
12 between the periodic filings of the affected electrical
13 utility's integrated resource plan.

15 (c) As used in this section:
16
17 (i) "Affected electrical utility" means a public
18 utility with at least X (X) retail electric customers in
19 the state;

24 This bill is based on Utah Code 54-17-301 which applies to
25 an "affected electric utility" defined as an electrical

1 corporation with at least 200,000 retail customers in the
2 state.

4 The Committee may wish to determine an alternative number
5 of customers or use a different definition of what
6 constitutes an affected electric utility.

10 (ii) "Integrated resource plan" means a plan
11 that contains:
12
13 (A) The demand and energy forecast by the
14 affected electrical utility for not less than a ten (10)
15 year period;
16
17 (B) The affected electrical utility's
18 options for meeting the requirements shown in its load and
19 resource forecast in an economic and reliable manner,
20 including:
21
22 (I) Demand-side and supply-side
23 options; and
24
25 (II) A brief description and summary
26 cost-benefit analysis, if available, of each option that
27 was considered.

2 (C) The affected electrical utility's
3 assumptions and conclusions with respect to the effect of
4 the plan on the cost and reliability of energy service;
5
6 (D) A description of the external
7 environmental and economic consequences of the plan to the
8 extent practicable; and
9
10 (E) Any other data and analyses the
11 commission may require.

13 Section 2. This act is effective July 1, 2024.
