A BILL
for
1 AN ACT relating to developmental preschool funding;
2 modifying the per child amounts used to calculate payments
3 to service providers; modifying requirements for the
4 department of health's budget request for developmental
5 preschool services as specified; providing an
6 appropriation; and providing for an effective date.

8 Be It Enacted by the Legislature of the State of Wyoming:

10 Section 1. W.S. 21-2-706(b), (d)(intro) and (e) is
11 amended to read:

2 (b) For purposes of calculating payments to service
3 providers for the subsequent fiscal year and preparing the
4 division's budget request to the legislature, the division
5 shall multiply the number of children age birth through
6 five (5) years of age with developmental disabilities who
7 are eligible for and placed on an individualized education
8 program or individualized family service plan through
9 developmental preschool services on or before December 1 of
10 the year in which the budget request is being prepared by
11 eight thousand five hundred three dollars ($8,503.00) ten
12 thousand one hundred fifteen dollars ($10,115.00) per child
13 per year. Eligibility for developmental preschool services
14 shall be determined by the state rules and regulations
15 governing an individualized education program or an
16 individualized family service plan.

18 (d) The per child amount specified in subsection (b)
19 of this section shall be increased by the amount of three
20 hundred sixty-three dollars ($363.00) four hundred thirty-
21 two dollars ($432.00) to provide:

1 (e) Commencing with the budget request for the fiscal
2 year 2010 2026 and for each fiscal year thereafter, the
3 department shall prepare an exception budget request
4 necessary to adjust the amounts calculated pursuant to
5 subsections (b) and (d) of this section and as previously
6 adjusted pursuant to this subsection, to reflect the most
7 recent external cost adjustment enacted by the legislature
8 pursuant to W.S. 21-13-309(o). The intent of this
9 subsection is for each budget request to incorporate all
10 previous adjustments made pursuant to this subsection.

12 Section 2. There is appropriated twelve million two
13 hundred ninety thousand three hundred twenty-eight dollars
14 ($12,290,328.00) from the general fund to the department of
15 health to be allocated pursuant to W.S. 21-2-706, as
16 amended by section 1 of this act. This appropriation shall
17 be for the period beginning July 1, 2024 and ending June
18 30, 2026. This appropriation shall not be transferred or
19 expended for any other purpose and any unexpended,
20 unobligated funds remaining from this appropriation shall
21 revert as provided by law on June 30, 2026. It is the
22 intent of the legislature that this appropriation be

1 included in the standard budget for the department of
2 health for the immediately succeeding fiscal biennium.
