A BILL
for
1 AN ACT relating to agriculture, livestock and other
2 animals; authorizing the state fair board to make
3 disbursements from its budget; requiring the state fair's
4 budget to be available to the public; authorizing the state
5 fair board to make and execute contracts; removing the
6 requirement that the director of the department of
7 agriculture be the chairman of any subcommittee created to
8 execute the annual state fair; and providing for effective
9 dates.

11 Be It Enacted by the Legislature of the State of Wyoming:

1 Section 1. W.S. 11-10-102(b) and (c)(intro), (vii)
2 and by creating new paragraphs (viii) and (ix) is amended
3 to read:

5 11-10-102. Duties and responsibilities with respect
6 to the annual state fair and fairgrounds.
7
8 (b) The department shall prepare budget requests on
9 behalf of and subject to the approval of the state fair
10 board for the conduct and management of the annual state
11 fair and for the operation and maintenance of the state
12 fairgrounds, including building and facility needs for
13 major maintenance and repair. The director is responsible
14 for the proper disbursement of all funds appropriated for
15 the annual state fair and fairgrounds. The state fair's
16 budget shall be made available to the public on the
17 department's website.

19 (c) The state fair board shall:

21 (vii) To the extent establishing a subcommittee
22 would aid in executing the annual state fair, appoint a
23 subcommittee of state fair board members to plan, conduct

1 or supervise the annual state fair. The director shall
2 serve as chairman of any subcommittee appointed under this
3 paragraph.

5 (viii) Pursuant to state contracting and
6 procurement laws, make and execute contracts and other
7 instruments, including financial contracts and instruments
8 that the state fair board determines are reasonable and
9 advisable to carry out the purposes and programs of the
10 state fair board. The attorney general shall review all
11 contracts under this paragraph before the contracts are
12 finalized;

14 (ix) Expend funds appropriated for the conduct
15 and management of the annual state fair and for the
16 operation and maintenance of the state fairgrounds.

18 Section 2. The state fair board shall promulgate all
19 rules necessary to implement this act.

1 (a) Except as otherwise provided by subsection (b) of
2 this section, this act is effective July 1, 2024.

4 (b) Sections 2 and 3 of this act are effective
5 immediately upon completion of all acts necessary for a
6 bill to become law as provided by Article 4, Section 8 of
7 the Wyoming Constitution.
