A BILL
for
1 AN ACT relating to state lands; authorizing state land
2 lease payments to be made electronically; providing that
3 state land lease renewals and rental payments are
4 considered filed on the date the renewal is postmarked; and
5 providing for an effective date.

7 Be It Enacted by the Legislature of the State of Wyoming:
8
9 Section 1. W.S. 36-5-118 is created to read:
10
11 36-5-118. Renewal of state land leases and rental
12 payments.

1 All state land lease renewal applications and rental
2 payments developed under this act that are submitted using
3 a mail service shall be deemed filed on the date of the
4 postmark stamped on the envelope in which the renewal
5 application or rental payment is mailed.

7 Section 2. W.S. 36-5-103 is amended to read:
8
9 36-5-103. Application for lease; cancellation of
10 application.

12 Any person, firm, association or corporation desiring to
13 lease state lands for agricultural and grazing purposes
14 shall file with the director an application on the form
15 approved by the board, which must be accompanied by the
16 regular filing fee, and a certified check, bank draft,
17 cashier's check, post office or express money order, cash,
18 or personal check or electronic payment acceptable to the
19 director for the full amount of the first year's rental
20 offered; and if there are improvements owned by another
21 located upon said lands, the applicant must also transmit
22 in the manner above provided, the estimated amount of the
23 value of the improvements as listed in his application, and

1 in the event the successful applicant fails, refuses or
2 neglects to complete the lease awarded, or otherwise fails,
3 refuses, or neglects to comply with the provisions of this
4 act, or the rules and regulations of the board, after
5 having been given thirty (30) days notice by registered
6 mail, the application shall be cancelled and the sum
7 remitted as rentals and twenty-five percent (25%) of the
8 sum remitted for improvements shall be retained by the
9 board as liquidated damages; and the sum paid as rental
10 shall be paid by the director to the state treasurer and
11 credited by him to the proper permanent land income fund
12 account, and the sum paid for improvements shall be
13 credited to the general fund.

15 Section 3. This act is effective July 1, 2024.
