A BILL
for
1 AN ACT relating to the prioritization of municipal solid
2 waste facilities cease and transfer projects; authorizing
3 expenditure of previously appropriated funds; establishing
4 a prioritized list of projects; establishing a maximum
5 amount to be expended on projects; granting the department
6 of environmental quality limited discretionary authority to
7 modify the prioritized list; specifying expenditures for a
8 carcass management project; providing definitions;
9 requiring reports; repealing a prior list of priority cease
10 and transfer projects; and providing for an effective date.

12 Be It Enacted by the Legislature of the State of Wyoming:

4 (a) As used in this section:
5
6 (i) "Maximum amount" means the total amount to
7 be expended on the listed project and reflects one hundred
8 percent (100%) of the project cost, including any award by
9 the state loan and investment board under W.S. 35-11-528;
10
11 (ii) "(C)" means closure project;
12
13 (iii) "SWDD" means solid waste disposal
14 district;
15
16 (iv) "(T)" means transfer project.

18 (b) From amounts appropriated by 2013 Wyoming Session
19 Laws, Chapter 194, Section 2(a) and (b), 2014 Wyoming
20 Session Laws, Chapter 26, Section 333(a) and (b), 2015
21 Wyoming Session Laws, Chapter 142, Section 345 (priority
22 2), 2016 Wyoming Session Laws, Chapter 31, Section 316(a),
23 2018 Wyoming Session Laws, Chapter 134, Section 323(a), (c)

1 and (d), as amended by 2019 Wyoming Session Laws, Chapter

4 program expenses, the following amounts and prioritized
5 projects are authorized pursuant to the municipal solid
6 waste facilities cease and transfer program created by W.S.

10 (c) Any municipal solid waste facility operator may
11 apply for the funds associated with the carcass management
12 project listed as priority 1 in subsection (b) of this
13 section. Funds for the carcass management project shall be
14 expended only for infrastructure necessary to haul, bury or
15 compost dead animals. Funds expended under this subsection
16 shall not exceed the amount listed in priority 1 in
17 subsection (b) of this section.

19 (d) The department of environmental quality may
20 modify the authorized funds and the order of the projects
21 listed in the prioritized list contained in subsection (b)
22 of this section for any of the following reasons:

1 (i) To optimize efficiency;

3 (ii) Based on project readiness;
4
5 (iii) Based on compliance with grant or loan
6 qualifications or conditions;
7
8 (iv) To address emergency or immediate
9 environmental concerns.

11 (e) Not later than October 15 of each year, the
12 department of environmental quality shall report:
13
14 (i) Any modification of the prioritized list
15 contained in subsection (b) of this section to the joint
16 minerals, business and economic development interim
17 committee and the joint appropriations committee;
18
19 (ii) The names of recipients and amounts
20 expended for the carcass management project established by
21 priority 1 in subsections (b) and (c) of this section to
22 the joint minerals, business and economic development
23 interim committee.

2 Section 2. 2023 Wyoming Session Laws, Chapter 12 is
3 repealed.

5 Section 3. This act is effective immediately upon
6 completion of all acts necessary for a bill to become law
7 as provided by Article 4, Section 8 of the Wyoming
8 Constitution.
