Behavioral health redesign amendments.

A BILL
for
1 AN ACT relating to public health and safety; requiring the
2 department of health to pay behavioral health services
3 claims as specified; requiring the department of health to
4 collect information regarding payment of behavioral health
5 services claims; requiring a report; amending definitions;
6 providing a sunset date; and providing for an effective
7 date.

9 Be It Enacted by the Legislature of the State of Wyoming:
10
11 Section 1. W.S. 35-1-613(a)(xix), as amended by 2021
12 Wyoming Session Laws, Chapter 79, Section 1 and as amended
13 by 2022 Wyoming Session Laws, Chapter 31, Section 1, is
14 amended to read:

1 35-1-613. Definitions.

3 (a) As used in this act:
4
5 (xix) "Indigent general access clients" means
6 persons who do not have private or public health insurance
7 that provides coverage for mental illness or substance use
8 disorder treatment and whose total household income is not
9 more than two hundred percent (200%) of the federal poverty
10 level. After July 1, 2026 a person who has private or
11 public health insurance that provides coverage for mental
12 illness or substance use disorder treatment shall not
13 qualify as "indigent general access clients";

15 Section 2. If a behavioral health center sends the
16 department of health a claim for behavioral health
17 services, the department shall pay the claim in the same
18 manner as it would have prior to the behavioral health
19 redesign, recognizing that providers have been and will
20 continue to be obligated contractually to bill private
21 health insurance and other liable third parties before
22 submitting claims to the state. The department shall
23 utilize its claims processing system and data warehouse

1 infrastructure to collect information on the potential
2 magnitude of savings from implementing additional third
3 party liability measures and shall report these findings to
4 substantiate a recommendation on the design of a new third
5 party liability system to the joint labor, health and
6 social services interim committee not later than September
7 1, 2025.

9 Section 3. This act is effective July 1, 2024.
