Regulation of propane delivery contracts.

A BILL
for
1 AN ACT relating to trade and commerce; authorizing propane
2 dealers to fill or refill a propane container during
3 emergencies as specified; providing definitions; and
4 providing for an effective date.

6 Be It Enacted by the Legislature of the State of Wyoming:

8 Section 1. W.S. 40-7-201 is created to read:

10 ARTICLE 2
11 PROPANE FILLS DURING EMERGENCIES

13 40-7-201. Propane fill or refill during emergencies.
14
15 (a) As used in this section, "propane" shall include
16 any liquefied petroleum gas that is offered for sale and is

1 composed predominantly of propane, propylene, butane,
2 isobutane and butylenes or any mixture of those
3 hydrocarbons.

5 (b) Notwithstanding any other provision of law, a
6 person who is not the owner of a propane container may fill
7 or refill that container with propane during the period of
8 any emergency that the governor has declared for the
9 purpose of facilitating a waiver from the United States
10 department of transportation and the federal motor carrier
11 safety administration that grants relief from title 49,
12 parts 390 to 399 of the Code of Federal Regulations.

14 (c) Any owner that authorizes a person to fill or
15 refill a propane container pursuant to this section shall
16 not be liable for any injury or damage that is caused by an
17 action of that person while the person is filling or
18 refilling the propane container under this section.

20 (d) A person who fills or refills a propane container
21 pursuant to this section shall not be liable for any injury
22 or damage that is caused by the condition of the propane
23 container.

2 (e) Nothing in this section shall be construed to
3 require a person who is authorized by an owner to fill or
4 refill a propane container under this section to fill or
5 refill that container.

7 Section 2. This act is effective immediately upon
8 completion of all acts necessary for a bill to become law
9 as provided by Article 4, Section 8 of the Wyoming
10 Constitution.
