A BILL
for
1 AN ACT relating to elections; revising provisions relating
2 to political party affiliation changes by electors;
3 specifying electors affiliated with a major political party
4 shall change their affiliation to another major political
5 party at least fourteen (14) days prior to a primary
6 election; providing conforming amendments; and providing
7 for an effective date.

9 Be It Enacted by the Legislature of the State of Wyoming:

11 Section 1. W.S. 22-1-102(a)(xxiii)(F)(IV), 22-5-212
12 and 22-5-214 are amended to read:

1 (a) The definitions contained in this chapter apply
2 to words and phrases used in this Election Code and govern
3 the construction of those words and phrases unless they are
4 specifically modified by the context in which they appear.
5 As used in this Election Code:

7 (xxiii) "Poll list" is the list of registered
8 voters as compiled by the clerk for use by election judges
9 at the polls. The poll list shall:

11 (F) Provide for the notation of:
12
13 (IV) For general elections, electors
14 who change political party affiliation at the polls.

16 22-5-212. When declaration of party affiliation
17 required.

19 An elector requesting a major party ballot must declare his
20 party affiliation, or sign an application for change of
21 affiliation in accordance with W.S. 22-5-214, before he may
22 receive a party ballot. An elector may vote only the
23 nonpartisan ballot and if so, is not required to declare

1 his party affiliation. Requesting a partisan primary
2 election ballot constitutes a declaration of party
3 affiliation. A change in declaration of party affiliation
4 shall conform to W.S. 22-5-214 and shall be entered on the
5 poll list by the election judge.

7 22-5-214. Change in party affiliation.

9 (a) Except as otherwise specified in subsection (b)
10 of this section, an elector may change his party
11 affiliation by completing an application signed before a
12 notarial officer or election official, and filing it with
13 the county clerk not less than fourteen (14) days before
14 the primary election or at the polls on the day of the
15 primary or general election, or when requesting an absentee
16 ballot.

18 (b) An elector may change his party affiliation from
19 one (1) major political party to another major political
20 party by completing an application signed before a notarial
21 officer or election official, and filing it with the county
22 clerk not less than fourteen (14) days before the primary

1 election or at the polls on the day of the primary or
2 general election., or when requesting an absentee ballot.

4 Section 2. This act is effective July 1, 2023.
