Hathaway fallen first responder scholarship.

A BILL
for
1 AN ACT relating to the Hathaway scholarship program;
2 creating the Hathaway fallen first responder scholarship;
3 modifying scholarship eligibility requirements as
4 specified; making conforming amendments; and providing for
5 an effective date.

7 Be It Enacted by the Legislature of the State of Wyoming:
8
9 Section 1. W.S. 21-16-1303(c) and
10 21-16-1304(c)(iii)(A), (h)(intro), (i) and by creating a
11 new subsection (j) are amended to read:

13 21-16-1303. Hathaway scholarship program; eligibility
14 requirements.

1 (c) Notwithstanding W.S. 21-16-l301(a)(viii),
2 students who are Wyoming residents and graduates of an
3 out-of-state high school shall be deemed to have graduated
4 from an eligible high school for the purpose of qualifying
5 under this article. Notwithstanding W.S.
6 21-16-1301(a)(viii) or paragraph (b)(i) of this section, a
7 student whose custodial parent or guardian is in active
8 military service and maintains Wyoming as that parent's or
9 guardian's state of domicile is deemed to be a Wyoming
10 resident and if a high school graduate of a high school
11 outside of Wyoming accredited by the appropriate regional
12 accrediting agency shall be deemed to have graduated from
13 an eligible high school for the purpose of qualifying under
14 this article. Notwithstanding W.S. 21-16-1301(a)(viii) or
15 paragraph (b)(i) of this section, a student whose custodial
16 parent or guardian was killed in the line of duty while
17 acting as a first responder, as defined under W.S.
18 27-14-102(a)(xxxi), and the parent or guardian was a
19 Wyoming resident at the time of the parent or guardian's
20 death and if the student is a high school graduate of a
21 high school outside of Wyoming accredited by the
22 appropriate regional accrediting agency, the student shall

1 be deemed to have graduated from an eligible high school
2 for the purpose of qualifying under this article.

4 21-16-1304. Hathaway opportunity, performance, honor
5 and fallen first responder scholarships.

7 (c) To remain eligible for the scholarship under this
8 section, the student shall:
9
10 (iii) Maintain a cumulative grade point average
11 as evaluated at the end of each spring academic term as
12 follows:
13
14 (A) For Hathaway opportunity and fallen
15 first responder scholarships, at least a 2.25 GPA;
16
17 (h) Notwithstanding subparagraphs (a)(i)(B), (ii)(B),
18 and (iii)(B) and (j)(i)(B) of this section, the applicable
19 scholarship amount awarded to any eligible student may be
20 available to that student, upon election, for enrollment in
21 up to six (6) semester hours during any summer academic
22 term or other academic term offered by an eligible

1 institution outside of the regular fall or spring semester,
2 subject to the following:

4 (i) The amount provided under subparagraph
5 (a)(i)(A), (ii)(A), or (iii)(A) or (j)(i)(A) of this
6 section, as applicable, for enrollment in up to six (6)
7 hours during any summer term or other academic term offered
8 by an eligible institution shall be available in an amount
9 equal to the proportion of the per semester scholarship
10 amount that the number of semester hours enrolled bears to
11 twelve (12);

13 (j) Any student whose custodial parent or guardian
14 was killed in the line of duty while acting as a first
15 responder, as defined under W.S. 27-14-102(a)(xxxi), and
16 the parent or guardian was a Wyoming resident at the time
17 of their death, and if the student is a graduate of a
18 Wyoming high school or a high school outside of Wyoming
19 accredited by the appropriate regional accrediting agency,
20 is eligible to receive a scholarship to pursue a degree or
21 certificate as follows:

1 (i) With a minimum cumulative high school GPA of
2 2.50 and a score equal to or greater than the 2015-2016
3 national percentile rank of forty-three (43) on a college
4 entrance examination administered throughout the United
5 States and relied upon by institutions of higher education
6 to determine acceptance of students for attendance, a
7 Hathaway fallen first responder scholarship for:
8
9 (A) One thousand six hundred eighty dollars
10 ($1,680.00) per semester at an eligible institution if
11 enrolled for twelve (12) or more semester hours;
12
13 (B) The amount provided under subparagraph
14 (A) of this paragraph times a fraction, the numerator of
15 which is the number of hours for which the student is
16 enrolled and the denominator is twelve (12), if enrolled at
17 an eligible institution for at least six (6) and less than
18 twelve (12) semester hours.

20 Section 2. This act is effective July 1, 2023.
